Labour Laws Applicable to Casual and Self Employed Work Force

Reliable estimates of employment and unemployment are obtained through quinquennial labour force surveys conducted by National Sample Survey Office (NSSO). Last such quinquennial labour force survey was conducted during 2009-10. As per results of the most recent survey, 15.6 per cent, 33.5 per cent and 51.0 per cent of the total work force on usual status basis was found to be engaged in regular wage/salaried work, casual labour and self employment respectively during 2009-10.

The Central labour laws applicable for the casual labour in the country are broadly The Minimum Wages Act, 1948, The Equal Remuneration Act, 1976, The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979, The Contract Labour (Regulation and abolition) Act, 1970, The Beedi and Cigar Workers (Conditions of Employment) Act, 1966 and The Unorganized Workers’ Social Security Act, 2008.

The matter regarding grant of financial Upgradation under MACP Scheme to those Hindi Officers, who have been initially appointed as Hindi Translators -grade II, after qualifying the Departmental examination, was referred to the Ministry for clarification as to whether, the appointment of such Hindi Translators is to he treated as fresh appointment or promotion, for grant of benefit under MACP Scheme

DOP&T vide ID No. 61550/12/CR dated 14,11.2012 has now clarified that such appointment shall be treated as direct recruitment and past service/promotion will not be counted for the benefits under ACP/MACP Schemes, in terms of clarification point of doubt No. 6 issued vide DOP&T F. No.
35034/I/97—Estt (D) (Vol. IV) dated 10.2.2000 circulated under AN/XI/11051/ACI’ dated 17.2,2012.

Antony has promised to remove anomalies in pension: Army Chief

Army Chief General V K Singh today said that the Defence Minister A K Antony has promised to remove the anomalies in the pension of ex-servicemen.

Addressing a gathering of ex-servicemen on Delhi's outskirts, General Singh said that the government is sensitive to the needs of the retired soldiers and efforts are being made to remove anomalies in their pension as identified by the sixth pay commission.

 
"After the sixth pay commission, 46 anomalies were discovered which were causing losses to the ex-servicemen. These have been put before government and we are committed to remove them to ensure that every one gets an equitable pension," he said.

OFFICE MEMORANDUM

Subject: Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2012.

 

The undersigned is directed to refer to this Ministry’s Office Memorandum No. 1 (14)/2011-E-II(B) dated 3rd October,2011 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 58% to 65% with effect from 1st January, 2012.

 

2 The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1 (3)/2008-E-II(S) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

 

3 The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

 

4 These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

 

5 In so far as the persons serving In the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the comptroller and Auditor General of India.

Your attention is invited to the above references and also to the other O.M.s which have been issued in this connection by DoPT, from time to time. Vide DoPT O.M. dated 30-08-2006, the Scheme of Optimization of Direct Recruit to Civilian posts has been extended upto 31st March, 2009, subject to a review being undertaken after receipt of the 6,h Pay Commission recommendations.

2. In view of the above, all Ministries/Departments are advised to immediately review the position regarding holding of Screening Committee Meetings. If there is a backlog of meetings, the same may be cleared without delay. The current year’s meeting should also be held expeditiously.

3. Indents of such Direct Recruitment posts, which have been cleared by the Screening Committees, should be placed well in time with the Recruiting Agencies, so that no dislocation is caused in the schedule of holding of the Recruitment Examinations.

4. In this connection, it is also pertinent to mention that the Department Related Parliament Standing Committee on Personnel, Public Grievances and Pension, Law and Justice, in their 14th Report have expressed concern over delays in filling up of Direct Recruitment vacancies.

5. All Ministries/Departments are therefore requested to ensure holding of Screening Committee Meetings regularly, so that indents could be placed, with

REPORT OF THE OFFICIAL PAY COMMITTEE (2011)

Revised Pay Structure & Pay Scales

(i) The State should continue to have its own Pay Structure for its employees.

(ii) The new Pay Structure is related to the index level of 191.5 points obtainable on 1.1.2012 (base 2001=100).

(iii) The concept of Master Scale with 91 stages are retained.

(iv) The Fitment Benefit is 22.5 per cent inclusive of 15 per cent Interim Relief.

(v) To retain the existing 25 standard scales, segments from the Master Scale.

(vi) The new pay structure includes the Dearness Allowance as on 1.1.2012 at the
index level of 191.5 points.

(vii) The revised Pay Scales, Allowances and Pensions are effective from 1.4.2012.

(viii) To revise the Minimum pay scale from Rs.4800-7275 to Rs.9600-14550.

(ix) To revise the Maximum pay scale from Rs.28275-39900 to Rs.56550-79800.

(x) The existing rates of increments have been doubled.

(xi) The new pay shall be fixed w.e.f. 1.4.2012 as follows.

1) Basic Pay as on  1.4.2012

2) DA of 76.75 per cent as on 1.1.2012

3) Fitment benefit of 22.5 per cent of basic pay inclusive of 15 per cent
Interim Relief.

(xii) The DA from 1.7.2012 is to be allowed with multiplication factor of 0.604 for
every 1 per cent  of DA sanctioned by Government of India.

AICPIN for month of February 2012

All India Consumers Price Index for Industrial Workers on Base 2001=100 for the Month of February, 2012
 
                         All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of February, 2012 increased by 1 point and stood at 199 (one hundred & ninety nine).
        
         During February, 2012, the index recorded maximum increase of 5 points in Puducherry centre, 4 points each in Ahmedabad, Bangalore and Mariani Jorhat centres, 3 points in 4 centres, 2 points in 10 centres and 1 point in 30 centres. The index decreased by 5 points in Quilon centre, 3 points each in Tiruchirapally and Salem centres, 2 points in 2 centres, 1 point in 8 centres, while in the remaining 17 centres the index remained stationary.
        
                        The maximum increase of 5 points in Puducherry centre is mainly on account of increase in the prices of Rice, Goat Meat, Poultry (Chicken), Curd, Snack Saltish, Country Liquor, Refined Liquor, Shirting Cloth (Synthetic), Bus Fare, Auto-rickshaw Fare, Barber Charges, Flower/Flower Garlands etc. The increase of 4 points each in Ahmedabad, Bangalore and Mariani Jorhat centres is mainly due to increase in the prices of Rice, Groundnut Oil, Mustard Oil, Goat Meat, Fish Fresh, Vegetable & Fruit items, Tea (Readymade), Electricity Charges, Flower/Flower Garlands, etc. The decrease of 5 points in Quilon centre is due to decrease in the prices of Coconut Oil, Fish Fresh, Onion, Vegetable & Fruit items, etc. The decrease of 3 points each in Tiruchirapally and Salem centres is due to decrease in the prices of Rice, Eggs (Hen), Onion, Garlic, Tamarind, Chillies Dry, Vegetable items, Flower/Flower Garlands, etc.
          The indices in respect of the six major centres are as follows :

                     The point to point rate of inflation based on CPI-IW(General) for the month of February, 2012 is 7.57% as compared to 5.32% in January, 2012. Inflation based on Food Index attained the level of 5.08% in February, 2012 as compared to 0.49% in January, 2012.

Revised Train Fares for Journey in AC-First Class, AC-2 Tier, Executive Class & First Class

Revised Train Fares for Journey in AC-First Class, AC-2 Tier, Executive Class & First Class

The Ministry of Railways has revised passenger fares with effect from tomorrow i.e. 1st April 2012 in AC-First Class, AC-2 tier, Executive Class and First Class only. There is no revision in other classes of travel. The revised fares in these classes would be applicable to all types of trains on Indian Railways network.

The revised fares will also apply to tickets issued in advance for journeys to commence on or after 1st April 2012. In the case of tickets already issued at pre-revised rates, the difference in fares from 1st April 2012 will be recovered from passengers either by TTEs in the trains or by the booking offices before commencement of the journey by the passengers as per the usual practice in case of such fare revisions.

The revised list of fares for the information of the public is being displayed at the stations and has been made available to the railway staff well in time. The revised passenger fare table is also available on the website of the Ministry of Railways i.e. indianrailways.gov.in

Subject: Promotion of Scientists Gr.‘A’ under Flexible Complementing Scheme - Issue of treatment of period of deputation/foreign service/leave etc. towards the minimum residency period.
The Flexible Complementing Scheme applicable to Scientists Gr.‘A’ in identified Scientific Ministries/Departments/Organisations provides for promotion of Scientists to the next higher grade on in-situ basis wíthout linkage to availability of vacancies on completion of the minimum prescribed residency period in the lower grade subject to acquiring the residency linked assessment norms. Earlier, there was a tack of uniformity in operation of Flexible Complementing Scheme in various Ministries/Departments/Organisations in various matters. The issue was examined in detail by the Fifth Central Pay Commission which recommended a modified Flexible Complementing Scheme with the purpose of rationalising and restricting the scope of FCS and also to bring a uniformity in the operation of the Scheme in Identified Ministries/Departments/organisations in matters such as designation of posts, scales operated under the Scheme, minimum residency period at various levels, assessment/screening in procedures, eligibility qualifications, etc. These recommendations were examined by the Government and were accepted with certain modifications vide DOPT Office Memorandum dated 9.11.1998. An umbrella Notification was also issued on the same date to amend certain provisions of the relevant Recruitment Rules with immediate effect to bring them in conformity with the decisions taken by the Government.

2. However, a lack of uniformity still persists in the matter of treatment of period spent on foreign service/deputation, study leave, and other kinds of leave, including leave on medical grounds, EOL etc., towards the minimum residency period required to be necessarily put in by a Scientist in the existing grade for promotion to the next higher grade. It has been considered that a uniform approach in this regard would be highly desirable.

3. The matter has been considered in all its aspects. It has been decided in consultation with the Ministry of Science & Technology that the period spent on deputation/foreign Service to another Scientific post, which helps a Scientist to acquire Scientific experience In a diverse set up and the necessary field experience now made mandatory for promotion to Sr. Scientific posts, as well as the period of Study Leave/any other Leave taken for improving the academic accomplishments, shall count towards the minimum residency period necessarily required to be put in the lower grade for promotion to the next higher grade. However, the period spent on deputation/foreign Service to a non-scientific post and the period of leave including leave on medical grounds, EOL etc. availed on personal grounds shall not count towards the minimum residency period.

4. All the Scientific Ministries/Departments/Organisations, where Flexible Complementing Scheme for Group ‘A’ Scientists is in operation, are advised to take note of the above decision for implementation.
