Subject: Grant of advances Sixth Pay Commission recommendations- Amendment to Rules 31, 35, 38,53,58,66 of Compendium of Rules on Advances to Government Servants
.
 
The undersigned is directed to say that in pursuance of the decision taken by the Government on the Sixth Pay Commissions recommendations relating to advances, the existing provisions of Compendium of Rules on Advances 31.35.38.53.58,66— relating to advances for purchase of bicycle, warm clothing, table fan and advances for festival and natural calamity are amended as per the amendments attached

2. These orders wilt take effect from the date of issue. The cases where the advances have already been sanctioned need not be reopened

3 The advance for purchase of table fan will stand discontinued. The advances for purchase of warm clothing and bicycle granted/sanctioned after issue of this order shalt be treated as interest free advances
 
4 The rates of these advances shall be increased by 25% every time dearness allowance on revised pay bands increases by 50%

5. In so far as persons serving in Indian Audit and Accounts Department are concerned. these orders issue in consultation with the Comptroller and Auditor General of India

6. All the Ministnes/DePartrnefltS are requested to bring the amendments to the notice of all its attached and subordinate offices for their information

AMENDMENTS TO COMPENDIUM OF RULES ON ADVANCE TO GOVERNMENT SERVANTS 2005

BI-CYCLE ADVANCE

RULE 31

In Rule 31:-

(a)ln thc opening clause indicating eligibility, for the words and figures “whose basic pay and dearness pay taken together does not exceed Rs.7. 500 (Rupees Seven thousand five hundred) per month”, the words and figures “whose grade pay does not exceed Rs.2. 800/- ( RupeesTwo thousand eight hundred)”. shall be substituted.

(b) In proviso (i) relating to amount of advance admissible, for the words “shall not exceed Rs.l .500 ( Rupees One thousand five hundred)”, the words and figures. “shall not exceed   Rs.3000/- (Rupees Three thousand)”, shall be substituted.

(c) Proviso (iii) relating to recovery of interest has been deleted.

 

WARM CLOTHING ADVANCE

RULE. 35


In Rule 35 relating to amount of Warm Clothing Advance admissible, for the words “shall not exceed Rs.l,5001- (Rupees One thousand five hundred)”, the words and figures, “shall not exceed R.s.3,000/- (Rupees Three thousand )“, shall be substituted.

Rule 38 relating to recovery of interest has been deleted.

FESTIVAL ADVANCE

RULE. 53

In Rule 53. in clause relating to ehgibility for Festival Advance, for the words and figures basic pay and dearness pay taken together does not exceed Rs.l2,450 (Rupees TWelve thousand four hundred and fifty) per month”, the words and figures” whose Grade pay does not exceeds Rs.4800/- (Rupees Four thousand eight hundred)” shall be substituted.


RULE58

In Rule 58 relating to amount of Festival Advance admissible, for the words “shall not exceed Rs.l500 (Rupees One thousand five hundred)”, the words and figures “shall not exceed Rs.3.000/- (Rupees Three thousand )“. shall be substituted.

 

NATURAL CALAMITY ADVANCE

RULE 66

In Rule 66 relating to amount of Natural Calamity Advance admissible, for the words “shall not exceed Rs.2,500/- (Rupees Two thousand five hundred)”, the words and figures” shallnot exceed Rs.5.000 (Rupees Five thousand)”, shall be substituted.

Note: I Rule 38F A- 38F relating to Table Fan Adance deleted.

      II The rates of these advances shall be increased by 25% whenever the Dearness Alowance payable on revised pay struture goes up by 50%

Consequent upon revision of Pay Scales on the basis of decision of the Government on the recommendations of the Central Pay Commission, the question of revision of existing entitlements to Passes/PTOs under the Railway Servants (Pass) Rules, 1986 (Second Edition, 1993) has been under consideration of this Ministry.

Sub: Children Education Allowance Scheme – Clarification

Subsequent to issue of this Department OM No. 12011/32008-Estt (Allowance) dated 02/09/2008 and clarificatory OMs dated 11/11/2008, 23/11/2009 and OM No. 12011/16/2009-(.Allowance) dated dated 13/11/2009 on the Children Education Allowance (CEA) Scheme, this Department has been receiving references from various Departments, seeking further clarifications.

The doubts raised are clarified as under:-

(i). Whether CEA is admissible to a Government Servant who ceases to be in service due to  retirement, discharge, dismissal or removal from service in the course of an academic year ? CEA/hostel subsidy shall be admissible till the end of the academic year in which the  Government servant ceased to be in service due to retirement, discharge, dismissal or  removal from service in the course  of an academic year.

The payment shall be made by the office in which the Govt. servant worked prior to these  events and will be regulated by the other conditions laid down under CEA scheme.

(ii). Whether Children  of  a Government servant  who dies while in  service are still   eligible for reimbursement under the new CEA scheme? If  a Government servant dies while in service, the  Children Education  Allowance  or hostel subsidy shall be admissible in respect of his/her children subject to observance of  other conditions for its grant provided the wife/husband of the deceased is not employed in service of the Central Govt., State Government, Autonomous Body, PSU, Semi-Government Organization such as Municipality, Post Trust Authority or any  other organization  partly  or  fully funded by the Central Govt/State Governments.  In  such  cases  the CEA/Hostel  Subsidy shall be  payable to  the  children  till  such  time the employee would  have  actually received the  same, subject to  the condition that other terms and conditions are  fulfilled. The  payment  shall  be  made  by  the office  in which the Govt. servant  was working  prior  to  his  death and  will  be regulated  by the other  condition laid down under CEA Scheme
iii) Whether any upper age limit of the children has been prescribed for ciaming  CEA?  Whether CEA can be allowed in case of children studying through  “Correspondence or  Distance  Learning”?  If  so  the age limit prescribed  for the same. The upper age limit for disabled children has been set at the age of 22 years. In the case  of other children the  age limit will now be 20 years or till  the  time  of  passing  12th class which ever is earlier.  Cases where reimbursement have been already made,  in  respect  of children above this age  may  not  be  reopened.  It  has  also been decided  that CEA  may  henceforth  be  allowed  in case of children  studying through  “Correspondence  or  Distance  Learning”  5ubject  to other  condition prescribed
iv)  What  is  the  definition  of  the terms ‘two sets 0f uniform’ which occur in para1(e) of  our  O.M. dated 2.9.08. What  is  the definition of ‘one  set of shoes’? It  is  clarified  that  ‘one set of  shoes’  would mean  one  pair  of  shoes  and  ‘two  sets of uniform’  would  mean  two sets  of  uniform  prescribed by the school in which the child is studying. A set of uniform will include all items of clothing prescribed  for a day,  as uniform  by  the  school. Reimbursement  may  be  allowed for two  sets  of  such  uniform  irrespective  of the  colours /winter/ summer/ PT uniform
(v) What is the definition of ‘station’ for the purpose of hostel  subsidy ? It is clarified that for the purpose of hosted subsidy,  station  would  be demarcated  by  the  first three  digits  of  the  PIN  Code  of  the  area  where  the Government   Servant  is  posed  and/or  residing’.  ‘The  first  three  digits  of  the  PIN Code  indicate a Revenue District
(vi) Whether  fee  paid  10 organizations/institutions  other  than  the  school  or fee  paid  to private  tutors  for purposes  mentioned  in  para 1(e) of  the  OM dated 2.9.2008  is reimbursable? No. It is clarified that the term ‘fee’ contained in the para 1(e) of the OM dated 2.9.2008 would mean the fee charted by the school directly from the student.

Retirement age fixation is Govt’s sole discretion: SC

Age of superannuation can be reduced or increased unilaterally at the discretion of the Government and courts cannot interfere with such decisions, the Supreme Court has ruled.

A three judge bench of Justices - J M Panchal, Deepak Verma and B Chauhan in a judgement quashed the interim orders of the Allahabad High Court which had directed the Mayawati Government to restore 62 years as the age of superannuation for Government pleaders (advocates).

The apex court agreed with the Government's view that fixing the age falls within the exclusive competence of the State authorities,and thus,the court should not interfere in such policy decisions,unless it was patently unconstitutional.

Citing the Constitutional Bench judgements in the Bishun Narain Misra vs the State of Uttar Pradesh (1965) case, the apex court said reducing the age of retirement could neither be invalid nor could be held to be retrospective as the said rule was a method adopted to tide over the difficult situation which could arise in public services.

"It is evident that even in government services where the terms and conditions of service are governed by the statutory provisions, the Legislature is competent to enhance or reduce the age of superannuation".

"In view of the above, it is beyond our imaginations as why such a course is not permissible for the appellant - State while fixing the age of working of the District Government Advocates," the bench observed.

In the instant case the High Court had stayed the operation of amended provisions of the U.P. Legal Remembrancer Manual (L R Manual) which sought to reduce the retirement age from 62 to 60 years.

It had further directed the State Government to consider the applications for renewal of the all District Government Counsel whose term had already expired, resorting to the unamended provisions of the L.R. Manual and they be allowed to serve till they attain the age upto 62 years.

The High Court under no circumstance could direct the State authorities to consider the cases for renewal/extension under the provisions of the unamended L.R. i.e. non-existing provisions.

Such interim order tantamounts to legislation by judicial orders,"Justice Chauhan writing the judgement observed. The apex court also recalled its earlier ruling in the Roshan Lal Tandon v. Union of India & Ors(1967)that emoluments of Government servants and terms of service".

"could be altered by the employer unilaterally for the reason that conditions of service are governed by statutory rules which can be unilaterally altered by the Government without the consent of the employee."

    The undersigned is directed to say that a suggestion has been made that physically handicapped candidates appointed under the Government  should preferably be posted in their native places or at least in their  native district.  The matter has been examined carefully.  It may not be possible or desirable to lay down that physically handicapped employees belonging to Group-A or Group-B who have all India transfer liability should be posted near their native places.   However, in the case of  holders of Group-C or Group-D posts who have been recruited on regional basis and who are physically handicapped, such persons may be given posting, as far as possible,  subject to administrative constraints, near their  native places within the region.
 

2.     Requests from physically handicapped employees for transfer to or near their native places may also be given preference.
 

3.     Suitable instructions may also be issued to all subordinate units.

Subject: Posting of Government employees who have  mentally retarded children.

     The undersigned is directed to say that there has been a demand that an employed parent of a mentally retarded child should be given posting at a place of his/her choice.  This demand has been made on the plea that facilities of medical aid and education of such children are not available everywhere.  Also looking after such children does require special care and patience and is expensive.  Hence some concessions from the Government at least in matters of posting at a place of choice is called for.

2.     The matter has been examined.  Considering that the facilities for medical help and education of mentally retarded children may not be available at all stations,  a choice in the place  of posting is likely to be of some  help to the parent in taking care of  such a child.  While administratively it may not be possible in all cases to ensure posting of such an employee at a place of his/her choice, Ministries/Departments are requested to take a sympathetic view on the merits of each case and accommodate such requests for posting to the extent possible.

Subject: Posting of husband and wife at the same station.

In view of the utmost importance attached to the enhancement of women’s status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the children, guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. Department had on 23.8.2004 issued instructions to all Mins./Deptts. to follow the above guidelines in letter and spirit.


2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, these guidelines have been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station. It is also necessary to make the provisions at Paras 3(iv) and (vi) of the O.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary.

3. On the basis of the 6th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of O.M. dated 12.6.97 have been amended.

4. The consolidated guidelines will now be as follows:
(i) Where the spouses belong to the same All India Service or two of the All India Services, namely lAS, IPS and Indian Forest Service (Group ‘A’);

 

- The spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse, on the request of the member of service subject to the member of service not being posted under this process to his/her home cadre. Postings within the Cadre will, of
course, fall within the purview of the State Govt.



(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs to one of the Central Services:-
- The cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted.

(iii) Where the spouses belong to the same Central Service:



- The Cadre controlling authority may post the spouses to the same station.



(iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:-



The spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of
the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists.


(v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking:



- The spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is
posted.


(vi) Where one spouse belongs to a Central Service and the other spouse belongs to a PSU:-



The spouse employed under the PSU may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.

(vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.:-
The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to
the State where the other spouse is posted.

(viii) - “The husband & wife, if working in the same Department and if the required level of post is available, should invariably be
posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be
applicable to the Govt. servant.



5. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee.

6. Although, normal channels of representations/complaints redressal mechanism exist in the Min./Deptts., added safeguards to prevent non- compliance may be provided by ensuring that the complaints against non-adherence to the instructions are be decided by the authorities at least one
level above the authorities which took the original decision when they are below the level of secretary to the Govt. of India/Head of the PSU concerned and all such representations are considered and disposed off in time bound manner.

Subject: Posting of husband and wife at the same station.

     The undersigned is directed to say that on the subject mentioned above, Government had issued detailed guidelines vide O.M.NO. 28034/7/86-Estt. (A) dated 3.4.86.  The Fifth Central Pay Commission has now recommended that not only the existing instructions regarding the need to post husband and wife at the same station need to be reiterated, it has also recommended that the scope of these instructions should be widened to include the provision that where posts at the  appropriate level exist in the organisation at the same station, the husband and wife may invariably be posted together in order to enable them to lead a normal family life and look after the welfare of the children, especially till the children are 10 years of age.

2.     The Government, after considering the matter, has decided to accept this recommendation of the Fifth Central Pay Commission.  Accordingly, it is reiterated that all Ministries/Departments should strictly adhere to the guidelines laid down in O.M.NO. 28034/7/86-Estt.(A)  dated 3.4.86 while deciding on the requests for posting of husband and wife at the same station and  should ensure that such posting is invariably done, especially till their children are 10 years of age, if posts at the appropriate level exist in the organisation at the same station and if no administrative problems are expected to result as a consequence.

3.     It is further clarified that even in cases where only the wife is a government servant, the concession  elaborated in para 2 of this O.M. would be admissible to the government servant.

4.     These instructions would be applicable only to posts within the same department and would not apply on appointment under the Central Staffing Scheme.

5.     A copy of this Department’s O.M. No. 28034/7/86-Estt. (A)  dated 3.4.86 is enclosed for ready reference and guidance.

Subject: Posting of husband and wife at the same station.

     The question of formulation of a policy regarding the posting at the same place of husband and wife who are in Govt. service or in the service of Public Sector Undertakings has been raised in Parliament and other forums on several occasions.  Govt.’s position has been that requests of Govt. servants and employees of public sector undertakings for posting at the same station usually receive sympathetic consideration, and that each case is decided on merits, keeping in view the administrative requirements.

2.     The Govt. of India have given the utmost importance to the enhancement of women’s status in all sectors and all walks of life. Strategies and policies are being formulated and implemented by different Ministries of the Central Govt. to achieve this end.  It is also considered necessary to have a policy which can enable women employed under the Govt. and the Public Sector undertakings to discharge their responsibilities as wife/mother on the one hand and productive workers on the other, more effectively.  It is the policy of the Govt. that as far as possible and within the constraints of administrative feasibility, the husband and wife should be posted at the same station to enable them to lead a normal family life and to ensure the education and welfare of their children.

3.     In Feb., 1976 the then Department of Social Welfare had issued a circular D.O. letter to all Ministries and Departments requesting them to give serious consideration to the question of posting husband and wife at the same station.  However, representations continue to be received by the Department of Women’s Welfare in the Ministry of Human Resources Development from women seeking the intervention of that Department for a posting at the place where their husbands are posted.  It has, therefore, now been decided to lay down a broad statement of policy at least with regard to these employees who are under the purview of the Govt./Public Sector Undertakings.  An attempt has, therefore, been made in the following paragraphs to lay down some guidelines to enable the cadre controlling authorities to consider the requests from the spouses for a posting at the same station.  At the outset, it may be clarified that it may not be possible to bring every category of employees within the ambit of this policy as situations of husband/wife  employment are varied and manifold.  The guidelines given below are, therefore, illustrative and not exhaustive.  Govt. desire that in all other cases the cadre controlling authority should consider such requests with utmost sympathy.

4.     The classes of cases that may arise, and the  guidelines for dealing with each class of case, are given below:-

(i)   Where the spouses belong to the same All India Service or two of the All India Services namely IAS, IPSA and Indian Forest Service (Group ‘A’);

-     The spouse will be posted to the same Cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse subject to their not being posted by this process to their home cadre.  Postings within the cadre will, of course, fall within the purview of the State Govt.

(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs to one of  the Central Services:-

-       The cadre controlling  authority of the Central service may post the officer to  the station or if there is no post in that station, the State where the other spouse belonging to the All India Service is posted.

(iii)   Where the spouses belong to the same Central Service;

-        The Cadre controlling authority may post the  spouses   to the same station.

(iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:-

       -      The spouse with the  longer service at a station may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station, or if there is no post in that station to the State where the other spouse belonging to the other Central Service is posted.

(v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertakings;

-     The spouse employed under the Public Sector  Undertaking may apply to the competent authority and said authority may post the said officer to  the  station, or if there is no post under the  PSU in that station, to the State where the  other spouse is posted.

(vi) Where one  spouse belongs to a Central Service and the other spouse belongs to PSU:-

-     The  spouse employed under  the PSU may apply to  the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the  State where the other spouse is posted.  If,  however, the request cannot be granted because the PSU has no post in the said station/State, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the  said officer to the station or if there is no post in that station, to the state where the spouse  employed under PSU is posted.

(vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the State Govt.

- The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the  station or if there is no post in that station to the State where the other spouse is posted.

5.     As will be sseen from the illustrations given above, they do not cover all possible categories of cases which may arise.  In fact it is not possible to anticipate all the categories of cases.  Each case, no covered by the  above guidelines will have to be dealt with keeping in mind the spirit in which these guidelines have been laid down and the larger objective of ensuring that a husband and wife are, as far as possible and within the  constraints of  administrative convenience, posted at the same station.

6.     Ministry of Finance etc. are requested to bring the above instructions to the notice of  all administrative authorities under their control and ensure compliance.

7.     In so far as persons serving in Indian Audit and  Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

8.     This issues with the concurrence of the Department of Public Enterprises.
